The commercial terms on which PFT Products sells and supplies machinery, parts and services.

These Terms & Conditions of Trade ("Terms") govern the sale of machinery, parts and services by PFT Products Pty Ltd ABN 85 689 412 299 ("PFT", "we", "us") to the buyer ("Buyer", "you"). By placing an order with PFT or any authorised PFT dealer, you accept these Terms.
Quotes are valid for 30 days from issue, unless otherwise stated. An order is binding once accepted in writing by PFT or an authorised PFT dealer. PFT reserves the right to refuse or cancel an order before acceptance.
Prices quoted are in Australian Dollars (AUD), exclusive of GST and freight unless explicitly stated. Pricing is subject to change without notice prior to order acceptance. Standard payment terms are full payment prior to delivery or as specified in the relevant invoice or finance agreement.
Delivery dates are estimates only and time is not of the essence. PFT will use reasonable endeavours to meet quoted delivery dates but accepts no liability for delays caused by suppliers, freight carriers, weather, customs clearance or other circumstances beyond our reasonable control.
Title in the goods remains with PFT until payment in full has been received by PFT in cleared funds. Risk in the goods passes to the Buyer upon delivery.
PFT reserves the right to make minor changes to machinery specifications, components and finishes without prior notice, provided the changes do not materially reduce the performance or value of the goods. Images on this website are for illustration only and may not reflect the exact specification of the unit delivered.
PFT machinery is supplied with the standard PFT manufacturer warranty as described on the Warranty & Support page, in addition to any rights and remedies under the Australian Consumer Law. Warranty cover does not extend to:
Goods supplied correctly to order are not returnable unless faulty. Where PFT agrees in writing to accept a return of non-faulty goods, a restocking fee of up to 20% may apply, plus freight costs.
To the extent permitted by law, PFT's liability in connection with the supply of goods or services is limited, at PFT's option, to repair or replacement of the goods, supply of equivalent goods, payment of the cost of replacement, or payment of the cost of repair. PFT is not liable for any indirect, consequential or special loss including loss of profits, loss of contracts or loss of use.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy conferred by the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010) or any other law which cannot lawfully be excluded.
Where the Buyer is an authorised PFT dealer, the additional terms of the PFT Dealer Agreement apply and prevail over these Terms to the extent of any inconsistency.
Neither party is liable for failure or delay in performance caused by acts of God, government action, war, riot, fire, flood, pandemic, strike, lockout or other circumstances beyond that party's reasonable control.
These Terms are governed by the laws of South Australia, Australia. The parties submit to the non-exclusive jurisdiction of the courts of South Australia.
